The prosecutor of the National Superintendence of Customs and Tax Administration (Sunat) filed this Thursday a motion to set aside the conviction of the constitutional Court (TC), which favors businessmen who must millionaire amounts in the state.

According to a statement shared on its social platforms, this decision “establishes rules based on precedents to substantially reduce the payment of default interest and tax debts in dispute”.

In addition, “it would benefit businesses that extend and maintain multi-million dollar debts with the state” and “deter voluntary and timely compliance with tax obligations”, a scenario that also favors the prosecution of new cases.

For the lawyer of the collecting body, this precedent allows large companies to no longer pay more than 12,000 million soles of unpaid tax interest.

In this sense, the formation of the TC “violates the right to a coherent decision and defense”, engages in arbitrariness and fails to consider that large companies “consent to delay in resolution”.

Finally, Sunat clarified that, in the last year alone, a record tax pressure has been recorded, the highest in the last 42 years, thanks to the entity’s actions aimed at improving levels of formalization and reducing tax rates. escape.
