BGH negotiates distribution of retention costs after water damage

The Federal Court of Justice (BGH) negotiated on Friday (09.00 a.m.) in Karlsruhe about the deductible after an insured event due to water damage. A homeowners association in Cologne is arguing about it. There has been water damage in the building several times due to defective pipes. (Ref. V ZR 69/21)

Previously, the joint insurance paid and the remaining deductible was split between the parties. Since there was water damage so often, the insurance company increased the deductible to 7500 euros. The plaintiff, a company based in the house, now no longer wants to pay a share of it: She is arguing that no damage has occurred to her property so far.
