Faced with this situation, the Ministry of Labor and Employment Promotion (MTPE) established two hours of tolerance for the workers of 233 districts of the regions of Ancash, Cajamarca, La Libertad, Lambayeque, Piura and Tumbes, the provinces of Lima and the metropolis of Lima, declared in a state of emergency due to imminent danger due to intense rainfall, by Supreme Decree No. 029 – 2023 – PCM.

The tolerance of two hours can be taken at the entrance or exit from his work center for this Monday March 13 and Tuesday March 14, as reported by the MTPE, through a press release posted on his social networks.

“Employers are encouraged to adopt flexible measures which make it possible to compensate for the involuntary delay time caused by this fact, allowing workers to enter to carry out their work, ”said the entity.

Likewise, he clarified that the hours that will be stopped should not be considered unjustified delays. Besides, must be compensated by prior agreement between the employer and the worker. “In the absence of agreement, it will be up to the employer to decide the question,” he said.

The MTPE pointed out that this measure in favor of the workers only applies to the provinces and districts included in the Supreme Decree No. 029 – 2023 – PCMand that there is also objective evidence of the climatological assignment.
