Minister Néstor Osuna at the table for talks with the ELN

One of the most important points in the cycle of dialogues that takes place between the delegation of the national government led by Gustavo Petro and the National Liberation Army – ELNhas to do with the penal and penitentiary policy project, whose socialization process was carried out by the Minister of Justice Nestor Osuna.

The bill, which aims to “humanise penal and prison policy”, was presented by Osuna to the delegation.

Faced with this, the ELN’s chief negotiator, Paul Beltran, announced what would have been discussed at the dialogue table; In addition, they said they agreed with the project because, according to their criteria, it has a humanitarian aim and considers more than 200,000 persons deprived of liberty.

“He laid out all the central elements of the prison reform, with which we agree because of its humanitarian character. The government as a whole provides assistance to detainees,” Beltrán commented.

He also mentioned that the law Project: “It coincides with the protocol that we raised in the table. The minister informed that they will stop considering or applying crimes like terrorism, this means they will be treated differently”.

It should be recalled that this point refers in particular to the project 336 of February 6, 2023 called: “By which criminal and penitentiary policy is humanized to help overcome the unconstitutional state of affairs.”

The initiative proposed by the national government aims to reform the regulatory and institutional framework concerning the enforcement of sentences with which he seeks to adapt it “to constitutional standards and the United Nations Minimum Rules for the Treatment of Prisoners”.

On the other hand, the ELN reiterated the importance of providing humanitarian aid to 40 guerrillas who are currently suffering from significant illnesses and health problems, who are also in various prisons throughout the national territory. Even before that, there is a commitment made by the government for the release of 8 people who are in terminal condition.
