Over 290,000 soles for minors injured in a mechanical game: Play Land Park fined by Indecopi

A year after the accident in which two miners were injured in mechanical gamesthe National Institute for the Defense of Competition and the Protection of Intellectual Property (indecopi) decided to impose a fine playground park (Fajume SA) with 290 thousand soles, equivalent to 58.6 ITU.

This sanction was pronounced exactly by the Consumer Protection Commission No. 3 of Indecopi in the first instance, so that the company in question can appeal.

Among the arguments against playground park generated an “undue risk to the health and safety of consumers, by not taking the necessary measures to ensure the proper functioning of its mechanical game”material horn”.

The decision was formalized by Resolution No. 012-2023-CC3 and was based on the provisions of Article 25 of the Consumer Protection and Defense Codereferring to the general duty of safety.

On the night of Friday March 11, 2022, two minors aged 11 and 13 were injured while enjoying the “Matter Horn” ride at Peru Jockey Club Play Land Parkin the neighborhood of Surco.

Reportedly, one of the carriages left the rail around 9:30 p.m., causing some passengers to be ejected from their seats at high speed.

“Four minutes passed and suddenly it stopped. It looked like a fire because people started screaming and we saw a girl asking for help for her friend and looking at the center. I didn’t I didn’t see that he got out of the cart, but rather that the boy flew away,” he said.

The accident was recorded by the mobile phone camera of those present. Investigations determined that a mechanical failure may have caused the fateful event.

After that, officers from Surco Inspection, the police and Indecopi arrived at the scene and ordered the temporary closure of the amusement park.
