The deputies of Morena continue to fight National Electoral Institute (INE) and the Federal Judicial Electoral Court (TEPJF)now after the Supreme Court of Justice of the Nation (SCJN) determined that the criterion of “honest lifestyle” cannot be a requirement for access to the public service.
It is in the Chamber of Deputies from where Morena Legislators They launched accusations against the councilors and magistrates of the two electoral bodies, assuring that by updating the criteria of an honest way of life, they sought to hinder the candidacies of aspiring Morenists.
The lawmakers of this party supported the decision of the Supreme Court which decided to invalidate this requirement. Hamlet García, secretary of the Political-Electoral Reform Commission, felt that both the INE and the TEPJF designed a “cheating system” to strip Morena of applications, especially those ‘caps’ who will run for the Presidency of the Republic for this party in 2024.
The MP said they were looking to apply cumulative administrative penalties for later refuse registration to candidates. And it is that with this update of the honest way of life, the INE has sought to stop the participation of officials who have carried out proselytizing during electoral processes.
While the deputy Reyna Ascencio considered that having an “honest way of life” represents a legal presumption that it should not be interpreted as defining whether or not a person can aspire to popular elected office.
In December 2022 INE has issued the guidelines to guarantee the neutrality, impartiality and electoral fairness for public officials, where limitations were established on the messages they could convey in press conferences, work reports, among others.
For these guidelines, the “honest lifestyle” criteria for running for office have been updated. There it was proposed that people who incur violations of electoral competition could be penalized, thus losing an honest way of life and the possibility of being penalized by being disqualified to stand for public office.
The measures were updated after the Superior Chamber of the Electoral Tribunal detected the the intervention of public officials During the electoral process in the state of Tamaulipas, as part of the discovery of Morena’s bottle caps for the presidency, Claudia Sheinbaum, Marcelo Ebrard and Adán Augusto López, who undertook state tours with electoral processes in progress.
However, this measure was challenged from the Presidency of the Republic and later the Supreme Court of Justice of the Nation (SCJN) declared its invalidity, with which INE to issue new guidelines for the impartiality and neutrality of elections without including offenses and sanctions that are not provided for in the Constitution.
During the meeting on Tuesday 7 February, the The court invalidated the new criteria established to the honest way of life, assuring that there was a contradiction of criteria when there was a subjective weightingthat is, the concept is ambiguous in concept, depending on who thinks about it.
After the decision of the highest court of the country, the Presidency of the Republic affirmed that at the time it had been affirmed that the INE exceeded its powerss, unduly restricting the politico-electoral rights public officials.
In addition, he brought back to the discussion the Electoral Plan Bsince he affirmed that with this package of reforms of the general law on electoral institutions and procedures, the faculties of the National Electoral Institute given their tendency to issue regulations that are outside their jurisdiction.
Since the middle of last year, Morena promoted reforms with which he sought change the law and thus frame the figure of the “honest way of life” as an obligation for a person to access a popular elected position.
