After a week of having visited the Santa Martha Acatitla women’s prison, the president of the Supreme Court of Justice of the Nation (SCJN), Arturo Zaldívar Lelo de Larrea, announced this Wednesday that the Federal Judicial Council (CJF) will initiate a process to ensure that there is a protocol for judges, so that they have clarity on what matters they can or cannot dictate justified preventive detention.

At a press conference, he pointed out that five measures were agreed to address the situation faced by people in prison, mainly women, who denounced various inconsistencies in their criminal proceedings.

1.- Effective and quality defense for 200 inmates starting this Thursday.

2.- Review of those cases that have been in preventive detention for more than two years.

3.- An agreement will be issued to concentrate in two or three district courts, the direct amparo cases of justified preventive detention, in order to put an end to the abuse of this figure.

4.- The strategic litigation will continue. Ex officio, all evidence will have to be analyzed with a gender perspective.

5.- A pilot program will be carried out in Oaxaca and Chiapas to determine the situation of indigenous people in prisons.

“Because of the characteristics we can achieve favorable results for the benefit of women. Of these 550 cases there are 25 of which we do not have any data, except for the number of the (criminal) case”

The minister clarified that these measures to review preventive detention are not aimed at the case of the former federal secretary, Rosario Robles, imprisoned for more than two years in Santa Martha Acatitla.

He stressed that the former official has a private defense, and according to their legal strategy, they can promote or not – in the courts and tribunals – the review of the preventive detention that keeps her in prison.
