Actor Octavio Ocaña consumed alcohol and marijuana, said the Prosecutor’s Office after expert reports

The Attorney General’s Office of the State of Mexico reported on Sunday night that it carried out various expert opinions regarding the death of the actor Octavio Ocana, 22, who was killed by a gunshot to the head while driving a truck, which was found on the Chamapa-Lechería highway, at the height of the Prados Iztacala neighborhood in the municipality of Atizapán de Zaragoza.

They announced that the Public Ministry conducted interviews with the two companions, in particular who was in the passenger seat reported that they had been consuming intoxicating drinks and when they circulated through the streets of Cuautitlán Izcalli municipal police stopped them, nevertheless, Octavio accelerated the march from the truck to avoid being arrested. This caused a persecution that extended to the Chamapa-Lechería highway.

According to the authorities’ version, the man declared that at one point during this persecution “Octavio took a firearm from the glove compartment of the truck, which he held in his right hand, while driving with his left and kept on fleeing. It should be noted that during this chase the truck collided with various vehicles”.

In the statement they stated that the expert opinions made indicate the following:

1. The ballistics expert test carried out on the firearm carried by Octavio N showed that it corresponds to a .380 caliber, and had two useful cartridges.

2. At the inspection of the truck a percussion cap was locatedIn the same way, he was subjected to the aforementioned ballistics test and this determined that he was fired by the .380 caliber firearm already mentioned.

3. These ballistic evidence found and analyzed have made it possible to establish that the bullet for which Octavio N lost his life was fired by a .380 caliber firearm, at close range.

4. The opinion of the mechanics of facts refers that during his flight the driver lost control, left the asphalt tape and hit his front right part; at this time and as a result of the dynamics of this mishap the driver presumably fired the firearm which he carried in his right hand.

5. The firing of the weapon produced an injury in Octavio N with the characteristics of Entrance orifice located in the right parietal and exit orifice in the left parietal, at an upward angle. From the trajectory of the bullet it is clear that it was fired from inside the vehicle and by the person who carried it.

6. In his statement before the Public Ministry, one of the municipal police officers who were traveling in the official unit that was chasing the truck that Octavio N was driving, declared that after its impact, he and his partner approached the unit and they found in the driver’s seat a person with an injury to the right side of the head, same as he was still alive and had a firearm in his right hand; by protocol this weapon was taken from the driver, to later make it available to the Public Ministry with the proper chain of custody.

7. The municipal police officers who carried out the chase assured the other two subjects who were traveling in the indicated van and they requested the support of emergency bodies to transfer the injured person to a hospital.

8. The toxicology report carried out on the deceased person determined positive for alcohol, with presence of ethanol above the cut-off point (80mg / ml), with a concentration of 143 / mg / dl; in the same way, it resulted with presence of tetrahydrocannabinol above the cut-off point (50ng / ml), which was greater than 100ng / ml.

9. The inspection carried out on the truck found three empty beer cans, as well as a glass bottle labeled “Jose Cuervo Traditional”, which was also empty.

10. From the results of the expert opinions described above, as well as the testimonies before the Public Ministry of the companions of the deceased and of the municipal police who carried out the aforementioned persecution, it is concluded that as a result of the impact of the truck, Octavio N accidentally fired the firearm at himself that he had in his right hand, The bullet hit him in the head and he lost his life due to this injury when he was taken to the hospital for medical attention.

All these expert tests were carried out by the General Coordination of Expert Services of this Attorney General’s Office, in strict compliance with the law and using duly accredited scientific methods.
