In the field of domestic work, the question arises as to the surcharges to be paid to a domestic employee who works overtime.

According to the regulations in force, it is established that a surcharge of 50% over the usual salary must be paid in case of overtime work on ordinary days. However, the situation varies on Saturdays after thirteen hours, Sundays and holidays, where the surcharge is 100% of the usual salary.

These surcharges are intended to recognize the additional effort and extra work time performed by domestic employees in special situations. It is essential to comply with these provisions to ensure fair compensation for the additional work performed.

It is important for both employers and employees to take these regulations into account to avoid conflicts and ensure a proper working relationship. Respect for rights and compliance with regulations are fundamental elements of fair and equitable domestic work.

How much money does a domestic worker earn today?

The implementation of the third and last tranche of the staggered salary increase for a domestic employee, which is equivalent to a 6% salary increase, has already come into effect. The increase was paid at the beginning of July and corresponds to the salary for the sixth month of the year.

At the beginning of this year, the National Commission for Domestic Workers established three progressive and non-cumulative increases based on March 2023 salaries. In April, a 14% increase was agreed, followed by a 7% increase in May and a 6% increase in June. All these adjustments were calculated based on March salaries.

How much should be paid to a domestic employee working overtime?

In addition, it was agreed to carry out a review to assess the impact of inflation on the remuneration of domestic employees on July 25. This implies that there is the possibility of establishing a new scale of increases for the coming months. The purpose of these changes is to guarantee adequate compensation for domestic employees and to adapt their salaries to current economic fluctuations. The scheduled revision will allow adjusting remunerations in accordance with the inflationary outlook and ensure fair compensation for these workers.

Recognition of seniority and Christmas bonuses

It is important to highlight two fundamental aspects that influence the salaries of female employees: seniority and Christmas bonus.

First, according to the wage agreement, employers are obliged to pay an additional 1% for each year of seniority in monthly salaries, regardless of the category or type of employment relationship. This calculation is made considering 1% for each year worked and must be reflected in each monthly receipt. Seniority is computed as from September 1, 2020, considering a full year until September 1, 2021.

On the other hand, as for the rest of the workers in a relationship of dependency, employers must pay domestic employees the Christmas bonus or the first Supplementary Annual Salary (SAC) of the year. This payment corresponds to 50% of the highest monthly remuneration paid during the first semester of the year (from January to June). The deadline for this payment is Friday, June 30.

These provisions seek to ensure recognition of the seniority of female employees and provide them with an additional economic benefit during the year.

Salaries paid in July

The salary scale in effect since June, and which began to be paid in June, is as follows, according to each category:

– Supervisor: $937 per hour with retirement; $1,026.5 per hour without retirement; $116,966 per month with retirement; $130,287 per month without retirement.

– Specific duties personnel: $887.5 per hour with recall; $973 per hour without recall; $108,668 per month with recall; $120,966 per month without recall.

– Housekeepers: $838 per hour and $106,023 per month.

– Care of persons: $838 per hour with retirement; $937.5 per hour without retirement; $106,023 per month with retirement; $118,151.5 per month without retirement.

– General labor: $777 per hour with retirement; $838 per hour without retirement; $95,345.5 per month with retirement; $106,023 per month without retirement.
