The judges of the Federal Oral Tribunal 2 of Comodoro Py, Jorge Gorini, Rodrigo Gimenez Uriburu, and Andres Basso, broadcasted the reasons why they sentenced Vice President Cristina Kirchner to six years in prison and a lifelong ban on filing a complaint, as scheduled, five minutes before 9. The arguments have been sent to the parties through the Lex-100 court system, and a special hearing is not scheduled. From that moment on, lawyers can appeal convictions and acquittals so that they can be examined by the Federal Chamber of Criminal Cassation. They will have ten working days for this, but it is likely that they will request an extension of this deadline due to the length and complexity of the case.
The decision, accepted by GlobeLiveMedia, is 1616 pages long and bears the signatures of the members of the tribunal and the secretary of the chamber, Tomas Santiago Cisneros. Due to the volume of the decision, the judges also drafted a 12-page index, where references to “recitation” and sentence device are grouped together. On December 6, the court sentenced the Vice President and eight others, including Báez, the former Secretary of Public Works Jose Lopez, the former head of the national roads directorate Nelson Periotti, and five former Santa Cruz officials to terms ranging from six to three years in prison. The judges understood that they had committed the crime of fraudulent administration to the detriment of the administration in the delivery of 52 public works for the province to Báez companies. The former President was also sentenced to a lifelong ban from holding public office. Additionally, they ordered the confiscation of 84 billion pesos for what they understood to be the proceeds of crime.
Meanwhile, four other defendants have been acquitted, including the former federal planning minister Julio DeVido, former Undersecretary of Public Works Abel Fatala, former Federal Plan official and cousin of the former President Nestor Kirchner, Carlos Kirchner, and former Santa Cruz official Hector Garro.
In the verdict, the judges set March 9 at 9 a.m. as the date and time to present the arguments for their decision. However, due to the public and political importance of the case, they have released an outline of their decision. They did so in an eight-page brief they released after the verdict.
“We found ourselves before an unprecedented event in the history of the country since it was proven that certain far-reaching decisions concerning the progress of the affairs of the group were adopted following express orders from the highest members of the national executive power. It has also been sufficiently proven that the strategy defined between officials and businessmen has been ensured by the publication of administrative acts of the above-mentioned agencies, always operating under the guise of legality,” they said.
There they explained that the main reasons for the Vice President’s conviction were the businesses that Báez had and the messages found on López’s cell phone, which the prosecutor’s office called the “plan to clean everything.” The judges have spoken about “libertine and corrupt ties” and “links that were decisive for the materialization of a fraud” in favor of the former President and Báez.
“It was decisive, in this logic, the verification of a manifest interest in the criminal plan of the President of the Nation Cristina Fernández de Kirchner, evidenced by her participation in the economic benefits produced from the crime obtained through multiple contracts and commercial ties with Lázaro Antonio Báez concomitantly with the execution of this maneuver,” they explained.
