The Viva Air case continues in the eye of the storm and of course in the sights of the corresponding authorities. In the last thing that was known about the measures for what happened in the last few days, is the Transport Superintendence could intervene the airline.
It should be recalled that Viva Air surprisingly suspended all its operations on the night of Monday, February 27, causing massive damage to various airports in the country and also to some international airports.
After this fact, the Colombian authorities began to take action on this matter. In this sense, it has been learned that the Superintendence of Transport will open an administrative investigation against the airline for the assignment caused by the sudden cessation of activities.
But that’s not all, the Supertransporte would intervene Viva Air in the coming days, according to recent statements by the Minister of Transport, Guillermo Reyes.
The portfolio manager confirmed in a dialogue with the Blu Radio station that this is a measure that could be taken, which has not yet been defined, but soon there will be an answer.
Guillermo Reyes recalled that an investigation focusing on the effects on users and also on issues related to free competition is already underway, one of the biggest questions that the airline has recently asked itself in the face of the insistence on merging with Avianca.
“The Superintendency of Industry and Commerce conducts all actions and investigations that correspond to the issue of consumer protection and also free competition. The Transport Superintendency is analyzing the decision on a possible intervention vis-à-vis Viva,” the portfolio manager said.
According to what Minister Reyes said, between this Friday, March 3 and Monday, March 6, 2023, the decision on the intervention of Viva Air by Supertransporte will be announced.
“The decision to proceed with this intervention must be announced sometime today until Monday at the latest,” the national government official said in the aforementioned interview.
It should be noted that in the event that Supetransporte condemns Viva Air, after the administrative investigation, it will have to pay between 1 and 2,000 current legal monthly minimum wages (smlmv), as established by the Colombian Aeronautical Regulations.
This only takes into account this action of the Superintendency in the case of consumer protection.
Remember that the airline Viva Air has a period of three days to respond to its users affected by the cancellation of flights.
“Directing the said airline to develop a User Attention Map with the telephone service: (+ 57) 601 3526700 Administrative headquarters Free line: 018000 915 615 www.supertransporte.gov.co in order to deal with the situation presented by this decision”, reads a press release published by the Superintendency in December 2. March.
“In addition, it is ordered the periodic delivery of the PQRD which is deposited by the users, the publication of a press release specifying the service routes and, that the compensatory measures and the reimbursement measures which may apply be implemented. . “, they added in the press release. document.
Faced with the crisis of Viva Air and the number of users affected by the sudden suspension of the operation of the airline, the Superintendence of Industry and Commerce (SIC) has issued some recommendations to citizens.
What the SIC seeks is to provide support and accompaniment to those who have been harmed by the cessation of the company’s activities.
According to the entity, what users affected by the Viva Air crisis should do is sue the airline for violating consumer rights.
With the recommendations issued by the Superintendency, there are only two simple steps that those affected by this situation should follow:
– Submit the claim virtually via the application provided by the SIC for this purpose: https://servicioslinea.sic.gov.co/servilinea/ServiLinea/DemandasProteccion/
– Subsequently, the complaint must be filed. For this step, there are two ways to complete the process, the first is by email to the Superintendency ([email protected]) or in person at the SIC offices in Bogotá.
It should be noted that in the case of domestic flights the claim must be directed against Viva Fast Colombia SAS, in the case of international tickets the claim is directed against Viva Airlines Perú SAC.
With these requests, according to the SIC, precautionary measures can be requested against the airline.
