The National Electricity Regulatory Entity (ENRE) filed a complaint on Thursday against the board of directors of the distributor Edesur. Yesterday the measure had already been anticipated and was going to be taken by the electric regulator.
In the text, 26 pages and which he accessed GlobeLiveMedia exclusively, the offenses of embezzlement, fraud to the detriment of the public administration and abandonment of people are mentioned, because of the repeated power cuts that took place during the summer. The complaint, which had been advanced yesterday by the Ministry of Energy, contains the arguments with which the government will seek to terminate the concession in its operating area.
The brief submitted by Walter Martello, head of the ENRE, supports two crimes, with the respective arguments to prove them. “Fraud for breach of agreed rights”, “Abandonment of people” and presents successive documents in which the agency required the company to take precautions in the face of possible supply cuts which, according to the Government, have not been heard.
“ENRE predicted in advance that the resources were not sufficient to meet the peaks in demand”, supports the text.
Among other evidence of abandonment of people, the agency lists the complaints of electrodependent people whose service was not replaced in time and service requests awaiting reading.
The lawsuit is just one step in the government’s move against one of two concessionaires of the Buenos Aires metropolitan area’s electricity distribution service, whose ultimate goal is to strip Edesur of the concession. The defendants are the president of the company, Juan Carlos Blanco; the failure, Francesco TutolYo; The directors Maria Alejandra Martinez, John Bobillo, Monica Diskin, John Zanchetta, jamie beard there Alexandre Martinezand the general manager Valter Moro.
Martello assures that these people “frustrated compliance with the conditions agreed in the electricity concession contracts”, but acknowledges that it does not currently have a “finished technical report allowing an exact description” of these malicious acts. .
The day before yesterday, ENRE issued a press release informing that it will send to Congress the results of this general audit in which the quality of the company’s service delivery was assessed.
The letter was posted on Twitter by Hammercontroller ENRE, who expressly specified that “the possible expiration of the concession” of the electricity distribution company is being assessed.
“The National Electricity Regulatory Entity (ENRE) informs that under Resolution ENRE No. 237/2023in the next 90 days, it will increase to Honorable Congress of the Nation and to the competent authorities, the technical report resulting from the in-depth audit ordered by the aforementioned resolution and which evaluates the performance of the supply of the public electricity distribution service by the company Edesur SA and the degree of compliance with the obligations contained in the concession contract,” the statement read.
“The current audit considers the operational and managerial assessment of the distributor that resulted in the lack of attention and timely form to user complaints and the replacement of the service, shortcomings that, beyond the global indicators and quality individuals, denote underlying issues that may affect the continuity of the dealership», closes the letter.
An official technical report dated yesterday on the operational situation of CABA distributors indicates that the company has “a total of 93 crews (64 contractors), divided into; 61 network repairs (41 contractors), 12 pipelines (contractors), 5 CT repairs (1 contractors), 15 laboratories (10 contractors) “and operational guarding”, i.e. a total of 108 teams (66 contractors), divided into; 20 network guardians (13 contractors), 84 claims guardians (53 contractors), 4 network controllers (contractors)”.
In any case, Edenor, the other company in the AMBA zone, posted better figures.
The same official sources pointed out that in 2020 President Alberto Fernandez He reportedly received a business situation report detailing its critical state, with a lack of investment and technical teams capable of handling the business and claims. Although the president met with Edesur management, the final decision was to proceed with the concession contract. From the sector, they have no doubt: the distributor’s current situation has worsened in recent years.
In the complaint, ENRE talks about the situation of electro-dependent people. From the government they point out that the areas most affected in this sense by the cuts are Lanús, Avellaneda, Esteban Echeverría and CABA.
“The company does not have the staff or supplies to standardize these areas. Also, the system for receiving complaints collapsed on the 14th, which is why no complaints were received until the morning of the 15th. They are recording a total of 300 to 400 complaints from electrically dependent users per shift 6 hours work and there are no generators for them in case the network repair is delayed. It should be noted that the shifts are 6 hours. There are 99 current cases of electro-dependent people,” they said.
