In preparation for the commemoration of International Women’s Day, the Congress of the State of Chihuahua adopted an initiative known as themy lawwhich contemplates reforms to the state Penal Code and the National Comprehensive Youth Criminal Justice Act in an effort to punish minors who commit the crime of attempted femicide.

With this, the Legislative Assembly will ask the Union Congress to give the green light to the proposal, so that the changes to the Sections 145 and 164 of the National Comprehensive Youth Criminal Justice Actwhich would allow internment to operate in the event of femicide in all its modalities, including the degree of attempt.

The initiative was presented since February 7, 2023 by the deputy of the National Regeneration Movement (Morena) Adriana Terrazas Porras and subsequently approved by the Justice Commission.

“In this specific case, the proposals on merit agree on the need to provide as a sanction the internment of offenders under the age of eighteen regarding the crime of femicide in the degree of attempt,” established the opinion

Regarding the changes made to Chihuahua Penal Code, it aims to increase penalties against those who commit crimes that attack women. “In the event of crimes committed because of sex, the applicable penalty will be between half of the minimum and three quarters of the maximum corresponding to the consummate intentional crime that the agent wanted to commit”, details the document which proposes to modify the law. . second paragraph and add a third to Article 75.

The initiative is called “Mya Law” in reference to Mya Villalobos Saldanaa young woman from Camargo, Chihuahua who, in October 2022, when she was 17, was stabbed 47 times by Eric “N”her boyfriend at the time, of the same age.

For this attack, the authorities had only issued precautionary measures against Erick “N” such as not approaching the town of Camargo, not leaving his place of residence (Delicias) and receiving help therapies. That’s to say, He would go on freely.

Later, the state attorney general’s office requested and succeeded in ordering the re-arrest of Erick “N” to place him in a rehabilitation center for adolescent delinquents.

However, on February 17, 2023, a hearing was held in which an amparo was made effective for the assailant, which is why the Chihuahua Superior Court of Justice suspended the arrest warrant against him and maintained the precautionary measures that had already been decreed previously.

From her experience, Mya has closely followed the legislative process to ensure that the reforms become effective, as she believes that the aggressors of women, even if they are minors, must be tried for the crime they have committed. .

Changes included in the proposal include an amendment to the Organic Law of the Office of the Attorney General of the State so that public prosecutors always act from a gender perspective. In addition, it was approved to sanction with an aggravated sentence the tort of injury committed against women in cases where it is used acid or corrosive substancewhose responsible could reach up to ten and a half years in prison.
