The ATU is sanctioned for an alleged case of discrimination in metropolitan France

There Lima and Callao Urban Transport Authority (ATU) was sanctioned with a fine of 9 UIT (S/ 44.550) for a case of discrimination against a disabled user in the Metropolitano service, as reported by the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi).

There Consumer Protection Commission No. 2 of the entity sanctioned the ATU, in the first instance, after a complaint from a user who indicated that up to three times, the Metropolitan workers They did not allow him to enter the Bertello feeder line bus, as well as Naranjal station and Los Alisos station.

Through a press release, Indecopi explained that in the acts mentioned by the plaintiff, he was in the preferential queue and would have demonstrated his disability. “These facts have been verified by the Commission and considered as acts of discrimination,” he added.

The complaint was filed by Iban Collahuazo Llacsahuanga on December 19, 2020 against the Protransporte Metropolitan Institute of Lima and by resolution, the Technical Secretariat decided, in 2021, to declare the ATU as a procedural successor, replacing Protransporte. The alleged instances of discrimination occurred during the months of June and July 2020.

In addition, Consumer Protection Commission No. 2 ordered the ATU to pay the plaintiff the costs of the proceedings, an amount which amounts to S/36. After learning of Indecopi’s decision, the ATU issued a statement, through its official channels, to clarify that the events that led to Collahuazo Llacsahuanga’s complaint against metropolitan staff for a case of discrimination occurred in June 2020, three months before taking over the management of the said transport service.

“As part of this transfer, the ATU took over the administration and operation of the Metropolis and the complementary corridors, as well as the complaints and sanctions formulated against the said services”, he specified.

In this sense, the ATU asserted that It is wrong that your staff discriminated against the requesting usersince they only took up their duties on September 14, 2020. “Since the ATU began its duties, our entity has taken measures in the continuous improvement of its employees, training them in order to provide a better service public transportation,” he said.

He also reported that they had a directive that regulates care for people with disabilities in the services of the Métropole, “in order to provide them with the help, guidance and support necessary for their comfort and safety”. In addition, he pointed out that his staff had received continuing education in coordination with the Ministry of Women and Vulnerable Populations and the National Council for the Integration of Persons with Disabilities (Conadis) with the aim of raising its quality standards in the service to people with disabilities and recalled that In collaboration with the Ministry of Culture, it has carried out campaigns against discrimination.

“The ATU strongly condemns any act of discrimination against people and even more so against people with disabilities. In this sense, it will support the actions that are carried out in favor of the protection of the rights of all our users,” he concluded.
