Margarita Cabello presented her questions regarding the bill.

From the Office of the Attorney General of the Nation, daisy hair returned to deliver his questions in relation to the Submission to Justice Act which was filed on Wednesday March 15, 2023 by the national government which, according to the lawyer: “does not have sufficient motivation” to apply.

Cabello’s intervention took place during the second national table for the fight against deforestation in the Amazon, which also took place that same Wednesday. The meeting was held at the Dann Carlton Hotel in the city of Bogotá and was presented by the Minister of Justice, Néstor Osuna, together with the Minister of the Interior.

According to the lawyer, there is a “mico” from which the authors could have important advantages because it is not explained in detail what are the reasons why it could be applied. In the words of Cabello: “it is important to be clear before presenting this project and that is why we believe that it protects the perpetrators more than the victims”.

One of the main concerns he expressed was the “principle of freedom”he mentioned that it is a question of granting null sentences to people who “engage in criminal activities such as conspiracy to commit a crime, massacres, murders of social leaders and drug trafficking, that is why we fear that this principle of opportunity is so lax and so weak”.

For Cabello, it can be very dangerous that the conditions relating to the sentences do not apply, where he pointed out that: “from the criminal point of view, I see that advantages are granted, sentences of up to eight years, but without any operating condition, and without there even being a manifestation of the will of the person responsible for the truth, it seems to us very dangerous”.

The lawyer also spoke before the extradition procedure. He noted that:

“The hardship budgets could agree on anything, like non-extradition. It’s the monkey I see there, because it can’t be so wide, when the correct thing is that the budgets for the subjection must be in order. It’s dangerous to leave that window open.”

With a statement issued on March 15, 2023, the Congress of the Republic of Colombia announced the beginning of the path traveled by the Submission Bill, considered one of the most important tools within the framework of the policy of “Complete Peace”.

The “bill of submission to ordinary justice, guarantees of non-repetition and law for the dismantling of organized armed structures of high-impact crime” proposed by President Gustavo Petro, was tabled in the Senate of the Republic in the head of Nestor Osuna of the Ministry of Justice and alphonse prada of the Ministry of the Interior.

From what happened in the meeting, Roy Barreras, President of the Senate, asked to treat the initiative urgently, this: “so that the uncertainty is less and that people know of which law avail”, since it must be remembered that in addition to Margarita Cabello, from the Office of the Attorney General of the Nation, other officials have warned against its prosecution without knowing in detail the conditions in which the Law of submission.

As the statement states, if the project is approved, “the so-called criminal gangs would have a two-year deadline to disband voluntarily”. In this sense, the structures must assume their responsibility for the crimes committed, in addition to issuing information giving an account of their modes of operation and offering reparation to the victims.

In exchange, the national government declares the imposition of a sanction which would range between 6 and 8 years old”effective prison”. In addition to this, it indicates that they can remain on probation for four years, as long as they carry out security activities. reparation to victims and catering. Otherwise: “Any member of these gangs who does not respect these conditions will pay the maximum amount of the penalty corresponding to the offenses committed, losing all discounts and advantages.

Faced with the questions that have arisen on the subject, Ivan Cepeda Castrosenator of the Historical Pact and president of the Peace Commission, assured that the project: “does not offer any kind of impunity (…) It is a path that is opening up for a total peace that is moving forward, despite the difficulties and despite the problems involved in an ambitious peace policy such as that of this government”.
