Ana Laura Bernal, MP for the Labor Party (PT), proposed to add Article 132 of the Federal Labor Law (LFT) so that it is the obligation of employers to grant a working day of paid leave workers who justify it, due to the symptoms caused by the menstrual period, they cannot fulfill their professional obligations.

Bernal Camarena clarified that when menstruation is not confined, the cúmulo de síntomas que la compañan alcanzan la categoría de síndrome, comme lo es el premenstrual y el de ovario poliquístico, la dismenorrea o incluso fermedades como la endometriosis que agravan los síntomas del menstrual period.

For this reason, the initiative was sent to the Labor and Social Protection Commission. In addition, during her argument, the PT deputy pointed out that many Mexican women experience very strong symptoms before and during their menstrual cycle. Furthermore, he mentions that some workers wish to be able to take time off from their workplace or at least take a break from their work activities, in order to be able to cope with symptoms and discomfort.

He also warned that despite the very strong pain felt by thousands of women due to the menstrual cycle, in most cases they were not allowed to miss their place of work. They’ve been told they’re “exaggerated”, “you’re sensitive”, “it’s your hormones”, “surely you’re in your day”, but they are rarely understood.

He argues that menstruation is experienced by many, suffered by many, and underestimated by many. Undoubtedly, only women who have experienced discomfort, colic, inflammation, spasms, nausea, vomiting caused by such strong pain and even fainting, can know what it is like to be in such a state of helplessness, and it is that sometimes painkillers are not even enough to reduce these symptoms.

For this reason, she says, underestimating the pain women feel during menstruation can even be discriminatory and misogynistic.

“Employers should give the same importance to these inconveniences that women experience month after month and thus grant them permission to be absent from their place of work”

This is in addition to what has been proposed by Verónica Delgadillo, senator of the Movimiento Ciudadano (MC), who has proposed that menstruating people have a work break of eight hours a month, this so that the worker can have an improvement in his quality of life.

“There are women who suffer from terrible colic, dizziness, nausea, there are women who faint and cannot even get up. Although we don’t talk about it, it’s a reality for many women in our country”

According to what Senator Orange said, during the menstrual cycle, one could miss a working day in the event that the health conditions are not optimal to respect the working day without this having an effect on salary perceptions or in social benefits or in work bonuses, which is why he reiterated that in the country there are women who need rest at work due to menstruation and that “there are conditions for the give”.

Likewise, the senator explained that her proposal was born from a whole legislative program that was formulated so that there is a dignified menstruation and to generate a public debate in the Mexican Senate on everything that revolves around the issue of menstruation. . “It allows us to make visible that there are many gaps in education, health, services, women’s rights,” she said.

Another aspect that he highlighted is that with the collective work between the organizations and the senators, it has been possible to achieve the zero rate of hygiene and menstrual management products in the revenue law of 2022. In this sense, he urged the political forces to join the debate to continue building a legislative agenda in favor of women.
