Digital platforms have changed the way we interact, today we can find a whole series of services available to us from the comfort of our homes, just by opening our electronic equipment.

A few years ago there was a revolution in the transport sector, the use of mobile phones to satisfy our need to travel has become commonplace, the same with the digital revolution of educational content that is available to us online from any device.

Today, with accelerated steps due to the COVID19 pandemic, technology puts us in front of another digital transformation, this time in access to health services.

There medical teleconsultation It is a model of care that is becoming universal, that grows from confinement and becomes an option for millions of people in our country who cannot travel to a doctor’s office or a hospital that prevents illnesses or continues their treatments.

The advantages of medical teleconsultation are enormous: he allows us remove geographical barriers in access to health services; It allows millions of people, such as the chronically ill, the elderly, minors, disabled people and even workers or students, to access a consultation with their doctor; he allows us implement more effective digital solutions for disease prevention and rapid diagnosis; allows us a the exchange of information to generate more effective treatments and their remote monitoring in a timely manner by health professionals.

However, in Mexico we lack a regulation for the operation of medical teleconsultationConsequently, teleconsultation service providers and patients lack clear rules to exercise their rights, but also to comply with obligations.

Today, we are unclear on the treatment of medical information shared on platforms such as zoom or other specific teleconsultation applications that are coming to market, so that sensitive user data is at risk; liability of service providers is also undefined, leaving patients defenseless against abuse, negligence or fraud; There is an absence of a process of certification of the functioning and quality in charge of the authority in charge of evaluating the institutions and the professionals who provide these services.

Therefore, in the Legislators in the Chamber of Deputies from various parliamentary groups took very seriously the task of proposing to create a regulatory framework that would make medical teleconsultation a reality. in our country, with clear laws for service providers, in addition to protecting the rights of patients.

During the session of the Chamber of Deputies on February 23, 2023, Éctor Jaime Ramírez Barba of PAN; Claudia Selene Avila Flores de Morena; Frinné Azuara Yarzábal of the PRI; Salomón Chertorivski Woldenberg of the Movimiento Ciudadano; Leticia Zepeda Martínez, Juan Carlos Maturino Manzanera and Vicente Javier Verástegui Ostos from PAN, we present an initiative that reforms the General Health Law with the following objectives***:

1. Medical teleconsultation will be a means of providing remote medical care, through the use of technology, for the purpose of diagnosing or treating a patient.

2. Everyone has the right to equal access to and use of technology necessary to benefit from medical teleconsultation services, which must be provided under conditions of safety, quality, efficiency, equity and inclusion.

3. The medical teleconsultation does not replace face-to-face carebut must be developed in a complementary and coordinated way.

4. In any case, Users of health services can decide that the consultation takes place in person.

5. Health service providers who provide the medical teleconsultation service will have the obligation to determine when the patient needs face-to-face medical care and to immediately refer him to the nearest health facility in case of ’emergency.

6. The diagnosis and treatment performed during the teleconsultation as well as the other observations must be recorded in the electronic clinical file of the patient.

We are sure that we are taking steps in the right direction, today more than ever Mexicans need timely, quality, fast and safe health services, all of which can become a reality through medical teleconsultation.
