The president of the Republic, To Boluarte, would not have testified for the nearly 60 deaths that occurred during the social protests that began against his government. This is because the national prosecutor, Patricia Benavidesdecided to suspend the recording of his testimony until the protection of the rights presented by the State Attorney Generalthat seeks to be included in the investigation, is resolved by the Judicial authority.
On Thursday March 2, the hearing of the Supreme Court of Preparatory Inquiry. On this occasion, the Attorney General’s office had exposed the protection of rights that seeks to cancel the extension of the declaration offered by the Prime Minister, Alberto Otarola, February 16. He is also involved in the ongoing investigation against Boluarte Zegarra for the alleged crimes of genocide, aggravated homicide and serious injuries.
The Peruvian state’s legal defense noted before the judiciary that what Otárola testified was carried out in flagrant violation of due process as well as right to defense of the injured party. In this sense, he mentioned that the Attorney General’s office had not been called upon to participate in the confidential procedure of the first.
“Our right to participate is not to sit and listen to what a researcher says, but to have the opportunity to ask questions through the Public minister (…) in this case, if a right to participate in the proceedings has been violated because we are not judges, we are a procedural party who has the right to actively participate because they have the right to know, their right to the truth, which has already been established by the Supreme Court”, have– they stated last week.
The state attorney general’s office was also unable to attend today’s stagecoach with Boluarte.
The president arrived a few minutes before 9 a.m. to testify before the Public minister. Unlike its predecessor Pedro Castillowho was walking in front of the aforementioned public entity to answer the questions of the prosecutor Patricia Benavides for the alleged acts of corruption of this administration, Boluarte preferred a car and with great security measures.
It should be remembered that the president responded to the appeal of the national prosecutor after presenting two reschedulings.
In January, Boluarte had been summoned for the first time, but she was not present because she had an agenda of activities. Then, the second occasion would take place on Thursday, March 23; however, he again argued that he could not go to the Public Prosecutor’s Office due to the violent protests in the Center of Lima it was risky for their safety to go to the tax office located on the avenue Abancay.
After frustrated debates, President Boluarte asked that his statement be virtual or taken in his office at the Government Palace. These conditions were supported by Prime Minister Otárola and the Head of the Justice Portfolio, Jose Tello.
“All Peruvians must defend what is called the institutionality of the Presidency of the Republic, which is so diminished by the unworthy use of this High Majesty of the State,” Otárola said during an activity for the anniversary of the Comptroller General of the Republic.
“It’s not that I don’t want to go to the prosecution. She (Boluarte) is willing to testify virtually. You have to respect the president in her decision; and, I repeat, you have to give the figure of the President of the Republic this spirit of respect that has been lost so much”, added Tello in dialogue with Canal N.
Experts consulted by GlobeLiveMedia question the attitude of President Boluarte when he compares it to Pedro Castillowho used all sorts of excuses to cooperate with tax investigations.
The former anti-corruption prosecutor Luis Vargas Valdivia described as “regrettable” the behavior of the head of state by rescheduling his testimony before the Office of the Prosecutor up to three times.
“Presidents must lead by example. It is true that because of their position they are busy, but they may also have time to comply with this obligation (declare before the public prosecutor) because they are not rendering a service. (Dina Boluarte) She is obliged to go and testify in order to help with the investigation and to show the public her full respect for the autonomous institutions,” he stressed.
Vargas Valdivia stressed that the president should be more concerned about clarifying the charges for the alleged crimes of genocide, homicide and serious injuries instead of making excuses such that the taking of their testimony is done in government palace or virtually.
For her part, the former lawyer Katherine Ampuero reminded that since Government They were going to collaborate with the Office of the Prosecutor. “They were going to differentiate themselves from the government of Pedro Castillo. He also said he would show his predisposition in front of the prosecution. They stressed that they were “transparent” and that they had nothing to fear. However, that is not the case,” he argued.
