Nexon continues its fight against Ironmace, the Dark and Darker development team. Following the lawsuit in Korea, where both studios are from, Nexon has decided to take legal action against Ironmace in the United States as well.
Although Nexon and Ironmace are Korean, the lawsuit argues that the U.S. District Court for the Western District of Washington is the proper jurisdiction, as the Dark and Darker tests were conducted on Steam (owned by Valve, based in Bellevue-Washington) and some of the game’s marketing has been targeted at US gamers.
The lawsuit also names former Nexon employees Ju-Hyun Choi and Ironmace CEO Terence Seungha Park for their involvement.
According to Nexon, Choi and Park were working at the company on a game substantially similar to Dark and Darker under the name P3.
The lawsuit stated, “In flagrant violation of their obligations to Nexon, the individual defendants stole the P3 source code, audio-visual equipment, and other materials that Nexon developed at substantial cost in time and money.”
At the moment, the future of Dark and Darker is still up in the air.
