He is 63 years old, was close to Dilma Rousseff and has just annulled the convictions of the former president of Brazil, Luiz Inácio Lula da Silva. Who is Edson Fachin, the Supreme Court Justice, and why has he made this controversial decision?

According to “El Espectador”, Fachin has several published books, as well as a master’s and doctorate “in law in social relations.” What’s more, “did postdoctoral work in Canada”.

He was a member of the Judicial Power Reform Commission […] and collaborated with the Senate in the drafting of the new Civil Code. He is also a member of the Brazilian Academies of Civil Law, Legal Letters and Constitutional Law.” Adds the medium.

His arrival at the top of the judiciary would have been due to his closeness to Rousseff, former president who nominated him for that position. Finally, in 2015 he became one of the 11 members of the Supreme Court.

Two years later, “appointed him to oversee Lava Jato-related cases”, and that’s where the controversy begins.

By 2015, the Notiamérica portal points out that he had become the most powerful judge in Brazil by “assume the position of president of the Federal Supreme Court”(Position now held by his colleague Luiz Fux), even though he had a lot of opposition because he was so closely linked to the Workers’ Party (PT).

Regarding Operation Lava Jato, he has been in favor of the testimonies awarded with sentence reductions, the formula used by Judge Sergio Moro to obtain information and involve dozens of politicians and businessmen”, notes the medium.

To this, “El Espectador” adds: “Since Lula was sent to prison in 2018, he insisted that he had not been well judged”.

And, today, Fachin annulled the sentences “of jail in the first instance dictated” against Lula, alluding that Judge Sergio Moro had no”legal competence”.

In this way, the trial against Lula returns to zero.
