Toledo has promised to surrender to US authorities for extradition if he stays out of jail, while his appeal is being considered.

In a brief filed with the federal court for the Northern District of California, based in San Francisco, his lawyers responded to the request of the American government that he be detained preventively before the extradition of the ex-president, requested by justice Peruvian for crimes of corruption.

His defense argued that in the three years since the start of the legal proceedings against him, he has never attempted to escape or leave US territory.
