EPS Sura responded to information published by the National Health Superintendency regarding a fine of $5.8 billion against him for breach of a guardianship judgment issued by the Barranquilla District Superior Court, as well as non-compliance with the instructions issued by the monitoring entity aimed at guaranteeing the protection of the right to health of a 75-year-old disabled lady.

The company specifies that the affiliate has received and is receiving all the necessary comprehensive medical care according to his condition, which always guarantees his right to health. However, the entity acknowledged that presented a delay of less than fifteen days by providing some social advantages such as the delivery of a bed and the assignment of a nurse eight hours a day to facilitate home care.
In accordance with this, the necessary actions will be implemented to prevent this from happening again. Likewise, he clarified that even the MORE is not confirmed.
“The resolution issued by the National Superintendency of Health is not a confirmed sanction, as it indicates that the appeals and cancellations proceed from the decision, which to date are in accordance with the terms of the law”, explained the EPS.
In turn, he explained that in these terms he will present the arguments in the exercise of his constitutional right of defence.
“Without a doubt, the sanction and its amount of 5.8 billion dollars are disproportionate and unprecedented in the country, as will be explained in the legal means available to the company,” EPS Sura stressed.
She reiterated her commitment to the affiliate and his family, whom she will continue to support to ensure the best care for his health.
The National Superintendence of Health announced on January 21, 2023 the opening of an investigation against EPS Sura for allegedly putting in place obstacles in the provision of the service to vulnerable patients.

After receiving the complaint, Supersalud investigated and was able to establish that there was alleged delays in specialist medical careand in the assessment by the attending physician for the determination and authorization of home health services, including nursing care and hospital beds.
The 75-year-old woman from Barranquilla, in addition to going to the superintendence, presented a protection assert their rights in court.
Thanks to this legal action, on December 5, 2022, the Second Barranquilla Family Court ordered EPS Sura to assess home doctor, to determine the appropriateness of health services and technologies required by the patient, which must be authorized and delivered immediately by the EPS.
However, according to the Superintendency of Health, the EPS allegedly ignored and did not comply with the court order.
“As a result of the non-compliance with the orders of the National Superintendency of Health, as well as the non-compliance with the court order, the Supersalud again intervened for Sura to immediately inform the measures taken to guarantee the services required at the user , whose new non-compliance, has generated the administrative investigation which determines those responsible for the alleged breaches highlighted throughout the monitoring of the control entity, ”clarified the entity.
