The former federal prosecutor argued the poor financial record of James Spears, which included a bankruptcy. In addition, he emphasized that the mother of Britney Spears, Lynne Spears, and her temporary caregiver Jodi Montgomery agree that James Spears be removed.

The attorney also noted that the termination of the guardianship must comply with the wishes of Britney not to undergo a mental or psychological evaluation, as permitted by the Succession Code.

James Spears announced in August that he would agree to resign from guardianship “when the time is right.” He explained, through his lawyer, Vivian Thoreen Lee, who “does not believe that a public battle with her daughter, because of her continued service as a caregiver, would be best for her”.

In September, James Spears and his team filed a petition to terminate the guardianship entirely after 13 years. “We are pleased with the recent forced concessions from Mr. Spears. Britney Spears was previously married to her childhood friend Jason Alexander and the dancer Kevin Federline, with whom she had her children Sean Preston, 16 years old, and Jayden James, of 15.
